Mohammad Reza Azimi

Mohammad is the principal migration agent in Shada Migration and Education Services.

As an Australian qualified education agent, he holds a Bachelor Degree in English Language Translation and a Graduate Certificate in Migration Law from the Australian National University. Mohammad is fluent in spoken and written Farsi, Dari and English, and is an accredited and licensed NAATI Persian translator. NAATI (The National Accreditation Authority for Translators and Interpreters) is the national standards and accreditation body for translators and interpreters in Australia.

Mohammad is active member of Migration Alliance, the professional associations for Australian migration service providers.He has worked as a tour guide for overseas visitors throughout Iran, and has a heartfelt understanding of his native country, Iran.

Between 1997 and 1999, he was an English Teacher at both the Open Education Centre of Azad University and the National Organization for Development of Brilliant Talents, in Tehran.In both Iran and Australia, Mohammad has worked as a translator, and has five publications to his credit.

Mohammad has extensive experiences in employment sector and community services in Australia and he has worked as an employment consultant for Mission Australia for 3 years.He was appointed as a representative of Mission Australia in Campsie Centrelink to helping the long-term unemployed and disadvantaged youth back into work.

From 2001 to 2006, he was the Iranian Correspondent for Archaeological Diggings, Australia's foremost Archaeological magazine.Between 2006 and 2008 he was a Journalist, where he contributed stories, essays and articles about the Iranian community in Australia.

He also owns and manages Shada Migration and Education Services.

Allan Hornery

Allan Hornery

Fr. Allan Hornery is well renowned for his diverse roles within many communities of NSW. Allan is a highly respected Priest, Counsellor, and Immigration Advisor for a Federal Member of Parliament, past Deputy Chair of the Board of Management for the Liverpool Migrant Resource Centre and a Migration Agent for Just Legal Solicitors, Barristers and Immigration and Shada Migration and Education Services.

In his early years, he took on a journey of spiritual enlightenment and joined a religious congregation where he spent twelve happy years of prayer, study, and teaching. This led him onto roles as Principal in schools of the Diocese of Bathurst, Wollongong and in the city of Sydney. Through his achievements, Allan was then appointed as a member of the NSW Disadvantaged Schools Commission for NSW and Educational Consultant for the Diocese of Wollongong.

In 1981 Allan decided to study for the Catholic Priesthood and was ordained to the Catholic Priesthood in December 1987. He was appointed as Director of Catholic Media, was a broadcaster on radio with a talk back program, wrote scripts for both radio and television and during this time studied for his Diploma of Media as well as managed Parishes and schools. He also held many posts in Chaplaincy to Hospitals and Nursing homes. In 2007 he decided to again take a different path and resigned from active parish Ministry to pursue the world at large and take on new ministry challenges.

Counselling has always been Allan's passion. Allan possesses over thirty years' experience as a counsellor assisting people and migrants of all nationalities through difficult times of separation, death, grief, marriage, drugs, alcohol and life counselling. With his relentless passion to help others, it had come with no surprise that he took the path as migration Agent to assist and reunite families, partners and refugees with a temporary or permanent visa to Australia.

Riaz Haffejee is an Australian Solicitor and Registered Migration Agent.

He works as an independent consultant with Shada Migration and Education Services, a migration firm that offers a full suite of migration services, especially to the Iranian community. At Shada he deals with all aspects of skilled migration and protection visa applications.

Riaz also has over 14 years’ experience as a lawyer in South Africa where he handled thousands of cases, in a deadline driven, litigation environment. His experience extends to consulting with clients, preparing case documentation, drafting correspondence and court documents, writing legal opinion, advocacy in court and settlement negotiations.

He attributes his past success as a lawyer in South Africa, and growth in his current role as an Australian migration agent, to a strong skillset, that includes analytical, time management and organisational skills. Administrative Appeals Tribunal

AAT (Administrative Appeals Tribunal) review decisions made by officers of the Department of Immigration and Border Protection to refuse or cancel visas.  AAT can also review decisions relating to approval and cancellation of sponsorship and nomination.

AAT is the amalgamated tribunal, will undertake the same functions as the MRT and RRT,  and decisions which could be reviewed in the former Migration Review Tribunal and Refugee Review Tribunal are now reviewed in our Migration and Refugee Division.

AAT is an independent review body and can help you by reconsidering your case and making a finding in relation to it. The AAT has the power to:

  • overturn or remit a decision
  • substitute another decision
  • return the case to the Department of Immigrationfor reconsideration, or
  • affirm the original decision.

The AAT must follow immigration law. Therefore, it does not have the power to grant a visa where the applicant does not meet all requirements for that visa.

Where the visa applicant or holder is in Australia then, they are the person who should apply for review. If the visa applicant is overseas, then in most cases the Australian sponsor, nominator or family member makes the application for review. In some cases the visa applicant must be in Australia in order to apply for review (eg where they applied for an onshore visa while in Australia).

The business sponsor or employer must apply for review in relation to business sponsorship and employer nomination decisions.

Business Migration Program

Overview

There are a number of visa options available for business people. Business people may apply for a visa to conduct short business visits, establish or manage a new or existing business or invest in Australia.

A two stage processing structure was introduced into the Business Skills Program on 1 March 2003. Most Business Skills applicants seeking to come to Australia need firstly to apply for a temporary (provisional) visa.They are eligible to apply for a permanent Business Skills visa once they have successfully operated a business or maintained their designated investment in Australia.

The following visa options are available for those business people who would like to migrate to Australia or who have already come to Australia on a temporary resident’s visa:

Business Innovation and Investment

Investor Stream

This stream is designed for those people who have a successful business or investment career, and have genuine and realistic commitment to being involved in investing, or in business, in Australia.

This is a temporary visa and you should meet the following criteria prior to submitting an expression of interest:

  • be under 55 years of age.
  • score at least 65 on pointing system
  • have a high level of management skill in relation to eligible investments or qualifying business activity
  • have at least three years' experience of direct involvement in managing a business or eligible investments
  • have a genuine and realistic commitment to continuing your business and investment activity in Australia

You must also:

  • have a total assets of at least AUD 2.25 million for the two fiscal years immediately before you are invited to apply
  • have an overall successful record of eligible investment or qualifying business activity
  • be ready to make a government-approved designated investment or managing your eligible investment of AUD 1.5 million for at least one of the five fiscal years before you are invited to apply
  • managing a qualifying business in which you owned at least 10 per cent of the total value of the business.

Business Innovation stream

The business innovation stream is designed for those business people who want to own and manage a new or existing business in Australia and have a a genuine desire to manage their business in Australia.

This is a temporary visa and you should meet the following criteria prior to submitting an expression of interest:

  • be under 55 years of age.
  • score at least 65 on Pointing System.
  • have a total annual turnover of at least AUD 500 000 in at least two of the four fiscal years immediately before you are invited to apply
  • own at least one of the following percentages of your main businesses:
    • 51 per cent of a business with a turnover of less than AUD 400 000 per annum
    • or 30 per cent of a business with a turnover of more than AUD 400 000 per annum
    • or 10 per cent of a publicly-listed company
  • have spent less than half your time on managing your business

You or your partner must also:

  • have total assets of at least AUD 800 000 that have been legally acquired and able to be legally transferred to Australia within two years of the visa being granted
  • have an overall successful business career with no involvement in unacceptable business activities.

Significant Investor Stream

This stream is for people who are willing to invest at least AUD 5 million into complying investments in Australia and want to maintain business and investment activity in Australia.

If you apply for the Significant Investor stream, you must be prepared to invest at least AUD 5 million in at least one of the following 'complying investments', such as Commonwealth, state or territory government bonds

When granted a visa, you agree not to take legal action against the Commonwealth for any loss of capital arising from your complying investment.


Premium Investor Stream

This stream is for people who are willing to invest at least AUD 15 million into complying investments in Australia and want to maintain business and investment activity in Australia.

If you apply for the Premium Investor stream, you must be nominated by Austrade on behalf of the Australian government.

Please note that income that you earn from your complying investment in Australia is subject to tax under Australian taxation law.You and your partner must not have been involved in unacceptable business or investment activities.

When granted a visa, you agree not to take legal action against the Commonwealth for any loss of capital arising from your complying investment.


Entrepreneur Stream

This stream is for entrepreneurs who have reached to an agreement from a third party for funding minimum AUD200 000 for either the commercialisation of a product or service or an activity leading to the development of a business in Australia.

If you apply for the Entrpreneur stream, you must be nominated by an Australian state or territory government.

The applicant must have at least competent English

Business Talent Visa

This visa is designed for those high-calibre business people who are owners or part-owners of an overseas business, and have a genuine and realistic commitment to participating in the management of an existing or new business in Australia.

The Business Talent Visas have two streams :1. Significant Business History stream 2. Venture Capital Entrepreneur stream

1.Significant Business History stream

To submit an expression of interest you should meet the following criteria:

  • be under 55 years of age.
  • net assets of at least AUD 400 000 in a qualifying business in at least two of the four fiscal years immediately before you are invited to apply
  • total assets of at least AUD 1.5 million that can be legally transferred to Australia within two years of the visa being granted
  • a total annual turnover of at least AUD 3 million in your main businesses in at least two of the four fiscal years immediately before you are invited to apply
  • having ownership of at least:
    • 51 per cent of a business with turnover of less than AUD 400 000 per annum,
    • or 30per cent of a business with turnover of more than AUD 400 000 per annum,
    • or 10 per cent of a publicly-listed company
  • an overall successful business career with no involvement in unacceptable business activities
  • a genuine desire to own and maintain a management role in a business in Australia.

2. Venture Capital Entrepreneur stream

If you apply for the Venture Capital Entrepreneur stream, you must have obtained at least AUD 1 million in funding from an Australian Venture capital firm for the start-up, product commercialisation or business development relating to a promising high value business idea.

Overview

Employer Sponsored VisasThere are a number of visa options available for lawfully operating Australian employers to recruit skilled workers to fill positions that cannot be filled from the Australian labour market.

The skilled workers may apply for either a temporary or permanent visa if an eligible employer is happy to employ and sponsor them.

The temporary visas under this category are as follows. Generally the temporary visa offers a pathway to a permanent visa.

Temporary Visas

Temporary Business Long Stay Visa

This visa (subclass 457) is designed for those Australian or overseas businesses to sponsor overseas workers to work for their company on a temporary basis.

You need a sponsor for this visa.

With this visa, skilled workers may work legally in Australia for between three months and four years, provided that they find a suitable employer to sponsor and employ them.


Service Sellers

Temporary Business Long stay (Service Sellers)

This visa is designed for the representatives of overseas suppliers of services who are negotiating, or entering into agreements to supply their services (not products) in Australia under the General Agreement on Trade and Services (GATS).

With the Service Sellers visa, sales representatives may negotiate the sale of services for between three months and six months.

No sponsorship is required for this visa,but the overseas company that you are representing must pay your salary and provide financial support during your stay in Australia. Service sellers must not be employed by a company based in Australia

If you hold this visa, you may bring any eligible secondary applicants with you to Australia and they may work and study during the time that you stay in Australia.

Service Seller visas cannot be extended beyond twelve months. If more time is needed in Australia, an entirely new application for subclass 457 must be lodged.

Permanent Visas

Regional Sponsored Migration Scheme

Regional Sponsored Migration Scheme(RSMS)

This scheme is to enable lawfully operating Australian employers to recruit, on permanent visas, highly skilled workers who are either from overseas or temporary residents already in Australia.

To meet the criteria of the Regional Sponsored Migration Scheme, an approved job must be:

  • Full-time;
  • Available for a minimum of two years;
  • Located in regional area;
  • Unable to be filled from the local labour market.

An employee must meet the criteria of the age, skill and language, and have an employer who is willing to sponsor him for this visa. If you hold this visa, your family may live,work and study in Australia permanently, and be eligible for Australian citizenship.


Labour Agreements

This visa is designed for applicants either from overseas or already in Australia.The applicants need to be nominated by an employer to work in an occupation where there is a shortage of workers. An agreement must exist between government and employer to recruit non- Australian workers.

You need a sponsor for this visa.

The visa is available on either a temporary or permanent basis.Applicants for a Labour Agreement visa must be less than forty five years old, and may not enter into an employment agreement of any kind outside the nominated position on their Labour Agreement visa.


Employer Nomination Scheme (ENS)

This scheme is to able lawfully operating Australian employers to recruit, on permanent visas,highly skilled workers who are either from overseas or temporary residents already in Australia. Under Employer Nomination Scheme, there is an offshore visa, and an onshore visa.

To meet the criteria of the Employer Nomination Scheme (ENS), an eligible job must;

  • Be full-time;
  • Be available for a minimum of three years;
  • Be a highly skilled occupation found on the Employer Nomination Scheme Occupation List, and meet the minimum salary level for ENS.

You need a sponsor for this visa. If you hold this visa, your family may live, work and study in Australia permanently, and be eligible for Australian citizenship.

Family Migration Program

Overview

Family ProgramThere are several migration visa options available for fiance(e)s, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Basically, family Program visa applications are processed on the basis of the family relationship with the sponsor in Australia.

There are no skills or language fluency tests for Family Migration Visa applicants.

There are four main categories for family migration program:

Partner Visas

Prospective Marriage

Prospective Marriage Visa (Offshore)

This visa is designed for people from overseas who wish to enter Australia and marry their fiancé within the nine-month validity period of the visa. Your fiancé must be Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Your partner is required to sponsor you for this visa, and you must marry within nine months of being granted the Prospective Marriage Visa.

Following your marriage, and before the expiry of your Prospective Marriage Visa, you may apply for a Partner Visa to allow you to stay in Australia.


Partner Visa

Partner Temporary and Permanent Visa (Offshore)

This visa is designed for people from overseas who wish to enter Australia and stay with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

It is for:

  • People intending to marry (fiancés);
  • Married partners;
  • De facto partners, including those in a same-sex relationship.

Your partner is required to sponsor you for this visa.

With this visa, you will be permitted to stay in Australia on temporary basis for two years. If your relationship still exists after two years, you may apply for permanent partner visa.

Partner Temporary and Permanent Visa (Onshore)

This visa is designed for partners and fiancés of Australian citizens, Australian permanent residents,or eligible New Zealand citizens to enter and remain permanently in Australia.

It is for:

  • People intending to marry (fiancés);
  • Married partners;
  • De facto partners, including those in a same-sex relationship.

Your partner is required to sponsor you for this visa.

With this visa, you will be permitted to stay in Australia on a temporary basis for two years.If your relationship still exists after two years, you may apply for a permanent partner visa.


Humanitarian Program (Offshore)

This program is designed for the holders of any permanent humanitarian visa to propose an immediate family member for entry to Australia through the offshore humanitarian program.

The immediate family members include:

General Skilled Migration

Overview

As a proportion of the overall migration program, the Skilled Stream has been growing steadily for many years. The general skilled migration program is an Australian Government initiative, which is aimed at young, highly skilled people who can rapidly make a contribution to the Australian economy.

The program is designed for those skilled migrants who can help to overcome skill shortages in Australia. Some classes of the visa do not require applicants to have an employer or relative sponsor them.

All GSM visa applicants must:

  • Be less than forty five years old;
  • Have good English language skills;
  • Have a post-secondary qualification;
  • Nominate a skilled occupation which is listed in the Skilled Occupation List (SOL);
  • Have relevant work experience in the nominated occupation.

This visa is designed for those people who have good English language skills as well as skills and qualifications for an occupation for which workers are in demand in Australia.

When you apply for the Skilled Independent Visa, your application will be assessed against a points test .If you attain the pass mark, your application will be processed further.

To be able to lodge a valid application for Skilled Independent Visa, you are required to submit and Expression of Interest (EOI) to Department of Immigration and Border Protection. Then applicants may receive an invitation to apply for this visa.

The advantages of this visa are that:

  • You do not need sponsorship to apply for this visa;
  • It allows you to travel to and enter Australia for five 5 years from the date it is granted;
  • Its expiry does not affect your permanent resident status if you are in Australia;
  • You may live and work in Australia on a permanent basis;
  • You could be eligible for Australian citizenship;
  • Your family may accompany you, and they may work and study in Australia.

This visa is designed for those people who have good English language skills, as well as skills and qualifications for an occupation which is in demand in Australia.

Applicants must be either sponsored by an eligible Australian relative living in a "Designated Area" or nominated by a participating state or territory government agency.

The visa is valid for four years. When you hold this visa you must abide by the condition that you live, work and/or study in "Regional Australia" or a "Designated Area".

To be able to lodge a valid application for Skilled Nominated or Sponsored Visa, you are required to submit and Expression of Interest ( EOI ) to Department of Immigration and Border Protection). Then applicants who are nominated by a participating state or territory government or sponsored by an eligible relative living in Australia may receive an invitation to apply for this visa.

You will have the opportunity to apply for permanent residency after you have lived for two years and worked at least twelve months in a Specified Regional Area of Australia.

In order to apply for this visa subclass, you must:

  • Be under 45 years of age;
  • Have good English language skills;
  • Have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL);
  • Be either sponsored by an eligible Australian relative living in a "Designated Area" or nominated by a participating state or territory government agency.

The advantages of this visa are that:

  • You may live and work in Australia for four years;
  • It provides a pathway to Australian permanent residence;
  • Your family may accompany you and they may work and study, but only in specified regional area of Australia.

This visa is designed for those graduates who have recently completed an engineering degree from a recognised overseas educational institution, whose skills are in needed in Australia.

The visa is valid for 18 months.if you hold this visa you may apply for permanent residence if you meet the criteria of the visa that you are applying for. Unlike other offshore skilled Program, the visa has no points test.

To apply for this visa subclass, you must

  • Be less than thirty-one years old;
  • Have good English language skills;
  • Have an engineering degree from a recognised overseas university.

The advantages of subclass 476 are that:

  • You may live and work in Australia for eighteen months;
  • It provides a pathway to Australian permanent residence;
  • Your family may accompany you and they may work and study;
  • There is no restriction on work and study.

This visa is an eighteen-month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two 2 years' study.

It allows applicants who are unable to pass the points test to remain in Australia for eighteen months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa.

There is no points test for applicants.

You must be in Australia to apply for this visa.

Step One: Assessment and Consultation

Usually we ask you to provide us with detailed information about your age, work history, education and English language ability as well as other relevant information through an assessment form.

You may fill out an online assessment form that is accessible in our website, or you may email us and request for an assessment form

After receiving the information, we will conduct an initial review of your assessment form and provide you with an email containing your most appropriate visa program to Australia.

Then you will be invited to participate in an interview either face to face or online

In the interview , you have the opportunity to ask any questions regarding your migration process, and a registered migration consultant will explain about your visa options and provide you with an estimate of fees

The initial assessment attracts a small consultation fee which the client requires to pay.

You will be asked to send us an email and request a formal agreement for services and fees if you wish to engage us with your visa application

Step Two: Signing the Contract

Upon receiving your email, we will provide you with a draft agreement of Services and Fees and " Consumer Guide" which contains information about the migration advice profession and what a client can reasonably expect from a migration agent and complaint procedures.

You will be advised about the detailed fees and charges for your visa matter on the draft agreement and we are more than happy to answer your questions about the agreement

You will be advised how long will be taking to process your visa application by the Department of Immigration and Border Protection.

When the agreement is signed, the responsible registered migration consultant will provide you with a letter of advice as well as a checklist about the documents that are required to be collected for the visa lodgement

Step Three: Visa Application Lodgement

Step One:Assessment and Consultation

Upon receiving the documents, we will conduct the documentation checks and review all supporting documentations to ensure that they are complete and a valid and strong visa application can be lodged.

At this stage, we will assist you to complete the application forms and check that all of the forms and supporting documentation are complete and correct. The Visa Application is then submitted to the relevant governing authority on your behalf.

We will pay for all the visa application fees on your behalf if you wish us to do so

Step Four: Visa Processing and the Decision

Anyone who has had their visa application reviewed and decided by Administrative Appeals Tribunal or is in detention (whether or not they have had their visa application reviewed and decided by the AAT may write to the Minister for Immigration and Border Protection (‘Minister’) asking the Minister to consider issuing a visa in the “public interest”.
